Media Release Agreement
This Agreement is entered into as of today, by and between Yourself, hereinafter referred to as the “Guest”, and Unalome Project, hereinafter referred to as the “Company”.
1. Grant of Rights:
The Guest hereby grants to the Company, its agents, representatives, employees, successors, assigns, and those acting with its authority, the unrestricted right and permission to copyright, use, reuse, publish, republish, and otherwise exploit the Guest’s performance, appearance, name, likeness, voice, and biographical information (collectively, the “Materials”), in whole or in part, individually or in conjunction with other materials, in any and all media now known or hereafter devised.
2. Commissioned Media:
Any music, videos, or other media commissioned by the Company from the Guest for the Maha Navratri Festival shall be the exclusive property of the Company. The Guest grants the Company all rights, title, and interest, including copyrights, in and to such commissioned media.
3. Release of Rights:
The Guest releases the Company, its agents, representatives, employees, and any third parties acting under the Company’s authority, from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses arising from the use of the Materials or any commissioned media.
4. Permission for Use:
The Guest grants the Company the irrevocable and unrestricted right to use, publish, display, and distribute the Materials and any commissioned media in any media, including but not limited to print, digital, social media, broadcast, and online platforms.
5. No Compensation:
The Guest acknowledges that they will not receive any financial compensation or royalties for the use of the Materials or any commissioned media.
6. Duration:
This release and consent agreement is valid perpetually, encompassing pre-event promotion, the festival itself, and post-event materials.
7. Representation:
The Guest represents and warrants that they have the right to enter into this Agreement and that the use of the Materials and any commissioned media as contemplated herein will not infringe on the rights of any third party.
8. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. The jurisdiction is Bengaluru, Karnataka.
9. Amendments:
Any amendments or modifications to this Agreement must be made in writing and signed by both parties.
10. Entire Agreement:
This Agreement contains the entire understanding of the parties relating to the subject matter herein and cannot be changed unless mutually agreed upon in writing.
11. Severability:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
